Please read these Terms of Service carefully before using kubeniche.com or requesting a no-obligation platform assessment from KubeNiche Inc. ("KubeNiche", "we", "us", or "our").
1. Acceptance of Terms
By accessing kubeniche.com or submitting an assessment request, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website or services. These terms apply to all visitors, leads, and clients.
2. Services Description
KubeNiche Inc. provides managed platform engineering, FinOps, Kubernetes SRE, and related cloud-native advisory services to business clients. The no-obligation platform assessment is a preliminary evaluation only and does not constitute a binding service engagement. Any formal engagement is governed by a separate Master Services Agreement (MSA) executed between KubeNiche and the client.
3. No-Obligation Assessment
The platform assessment is provided at no cost and with no obligation to engage KubeNiche for paid services. The written findings report delivered as part of the assessment is for informational purposes only. KubeNiche makes no warranties regarding the completeness or accuracy of assessment findings, which are based solely on information provided by the requester during the assessment process. Information shared by the requester during the assessment will be treated as confidential and used solely for the purpose of preparing the findings report.
4. Intellectual Property
All content on kubeniche.com — including text, graphics, logos, and service descriptions — is the property of KubeNiche Inc. and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent. The written findings report delivered to you as part of your assessment is licensed to you for internal use only.
5. Prohibited Use
You agree not to use this website or our services to: (a) submit false or misleading information; (b) attempt to gain unauthorised access to our systems; (c) transmit malware or harmful code; (d) violate any applicable law or regulation; or (e) infringe the intellectual property rights of KubeNiche or any third party.
6. Disclaimer of Warranties
This website and the no-obligation assessment are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. KubeNiche does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. These terms apply exclusively to business clients. KubeNiche does not provide services to consumers as defined under the Ontario Consumer Protection Act.
7. Limitation of Liability
To the maximum extent permitted by applicable law, KubeNiche Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or the no-obligation assessment, even if KubeNiche has been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these terms shall not exceed the greater of CAD $100 or the total fees paid by you to KubeNiche in the three (3) months preceding the claim. Nothing in these terms limits liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence.
8. Third-Party Links
Our website may contain links to third-party websites. These links are provided for convenience only. KubeNiche has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Ontario, Canada. For clients outside Canada, KubeNiche reserves the right to seek injunctive relief in any competent jurisdiction.
10. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes take effect immediately upon posting to this page. For material changes, we will notify you by email if we hold your contact information. Your continued use of the website after changes are posted constitutes your acceptance of the revised terms. We will update the "Last Updated" date accordingly.
